These Terms of Service ("Terms") govern your access to and use of CareSnap, EVVbot, and all related websites, mobile applications, communication services, and workforce management tools (collectively, the "Services") operated by CareSnap, Inc. ("CareSnap," "we," "our," or "us").
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy located at https://www.caresnap.com/privacy-policy.
If you do not agree to these Terms, do not access or use the Services.
Description of Services
CareSnap provides workforce management, caregiver scheduling, communication, Electronic Visit Verification (EVV), attendance tracking, operational messaging, and related services for healthcare organizations and their authorized users.
CareSnap does not provide medical advice, nursing services, emergency services, or healthcare treatment.
Eligibility
You must be at least 18 years old and legally authorized to use the Services.
If you use the Services on behalf of a healthcare agency, employer, or other organization, you represent that you are authorized to bind that organization to these Terms.
User Accounts
Users may be required to create an account to access certain Services.
You agree to:
Provide accurate and current information.
Maintain the security of your credentials.
Notify CareSnap of unauthorized access.
Accept responsibility for activity occurring under your account.
CareSnap may suspend or terminate accounts that violate these Terms or threaten platform security.
Authorized Use
You agree to use the Services only for lawful purposes.
You will not:
Violate applicable laws or regulations.
Access systems without authorization.
Interfere with platform operations.
Upload malicious software or harmful code.
Misrepresent your identity.
Use the Services for fraudulent or deceptive purposes.

Other approved communication methods
Communications are intended to support scheduling, workforce operations, Electronic Visit Verification, compliance, account administration, and customer support.
SMS Messaging Terms
Consent to receive SMS messages is not a condition of employment, of any purchase, or of using the Services. Users may decline or revoke SMS consent and continue to use the Services; the same information remains available in the application and by email.
Wireless carriers are not liable for delayed or undelivered messages.
Express Consent Required
Users may choose to receive SMS communications from CareSnap and EVVbot by providing express consent through a registration form, onboarding process, account settings, or other authorized opt-in mechanism.
Users are not automatically enrolled in SMS messaging merely by downloading an application, creating an account, or using the Services.
By selecting an SMS consent checkbox or otherwise providing express written consent, users agree to receive operational SMS communications from CareSnap and EVVbot.

Message frequency varies based on user activity, schedules, assignments, and account settings.

Message and data rates may apply.
Opt-Out
Users may opt out of SMS communications at any time by replying:

After opting out, users will no longer receive SMS messages except as required to process the opt-out request or as otherwise permitted by law.

SMS Privacy
Mobile phone numbers, SMS consent records, and SMS messaging data are not sold, rented, shared, transferred, or disclosed to third parties or affiliates for marketing or promotional purposes.
SMS consent is not shared with third parties or affiliates for marketing purposes.
Privacy
Use of the Services is subject to the CareSnap Privacy Policy, available at https://www.caresnap.com/privacy-policy.
The Privacy Policy explains how information is collected, used, stored, and protected.
By using the Services, you acknowledge and agree to the practices described in the Privacy Policy.
User Content
Users may submit information, schedules, messages, notes, assignments, documentation, and other content through the Services.
Users retain ownership of their content.
Users grant CareSnap a limited right to store, process, transmit, display, and use such content solely as necessary to provide the Services.
Users are responsible for ensuring that submitted content is accurate and lawful.
Intellectual Property
The Services, including software, content, trademarks, logos, graphics, workflows, and technology, are owned by CareSnap or its licensors.
Nothing in these Terms transfers ownership rights to users.
Users may not copy, modify, distribute, reverse engineer, or create derivative works without written permission.
Service Availability
CareSnap strives to maintain reliable Services but does not guarantee uninterrupted availability.
Services may be interrupted due to:
Maintenance
System upgrades
Network issues
Third-party service interruptions
Events beyond CareSnap's reasonable control
CareSnap reserves the right to modify or discontinue Services at any time.
Third-Party Services
The Services may interact with third-party providers, including telecommunications carriers, hosting providers, cloud infrastructure providers, mapping providers, and communication vendors.
CareSnap is not responsible for third-party systems or services beyond its control.
Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARESNAP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND AVAILABILITY.
CARESNAP DOES NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE OPERATION OF THE SERVICES.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARESNAP SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SERVICES.
CARESNAP'S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:
(A) $100 USD; OR
(B) AMOUNTS PAID TO CARESNAP DURING THE TWELVE MONTHS PRECEDING THE CLAIM.
Indemnification
Users agree to defend, indemnify, and hold harmless CareSnap, Inc., its officers, directors, employees, contractors, affiliates, and agents from claims, liabilities, damages, losses, and expenses arising from:
Violation of these Terms;
Misuse of the Services;
Violation of applicable laws;
Infringement of third-party rights.
Termination
CareSnap may suspend or terminate access to the Services if:
These Terms are violated;
Required by law;
Necessary to protect users, systems, or operations.
Users may discontinue use of the Services at any time.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Changes to Terms
CareSnap may update these Terms periodically.
Updated Terms will be posted on this page with a revised Effective Date.
Continued use of the Services after updates become effective constitutes acceptance of the revised Terms.
