Welcome to CareSnap.

These Terms of Service ("Terms") govern access to and use of CareSnap, EVVbot™, and related websites, applications, communications, and services (collectively, the "Services") operated by CareSnap, Inc. ("CareSnap," "we," "our," or "us").

By accessing, registering for, or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

About CareSnap

CareSnap provides healthcare workforce management, scheduling, communication, Electronic Visit Verification (EVV), caregiver coordination, and related operational services for healthcare organizations and their authorized users.

CareSnap does not provide medical care, nursing services, clinical treatment, or emergency services.

Eligibility

You must be at least 18 years of age and legally authorized to use the Services.

If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

User Accounts

Users may be required to create an account to access certain Services.

You agree to:

  • Provide accurate and current information.

  • Maintain the confidentiality of account credentials.

  • Notify CareSnap of unauthorized account access.

  • Accept responsibility for activities occurring under your account.

CareSnap reserves the right to suspend or terminate accounts that violate these Terms or threaten the security or integrity of the Services.

Permitted Use

You may use the Services only for lawful purposes and in accordance with these Terms.

You agree not to:

  • Violate applicable laws or regulations.

  • Access systems without authorization.

  • Interfere with platform functionality or security.

  • Upload malicious code or harmful content.

  • Impersonate another person or organization.

  • Use the Services for fraudulent, abusive, or deceptive purposes.

Communications

By providing contact information to CareSnap, you consent to receive communications related to your use of the Services.

Communications may be delivered through:

  • In-app notifications

  • Email

  • SMS text messages

  • Telephone communications

  • Other authorized communication channels

Users may update communication preferences where available.

SMS Messaging Terms

By providing a mobile phone number and opting in to receive text messages, you consent to receive SMS communications from CareSnap and EVVbot™.

These communications may include:

  • Electronic Visit Verification notifications

  • Schedule updates

  • Shift assignments

  • Visit reminders

  • Attendance notifications

  • Account alerts

  • Support communications

  • Workforce-related operational messages

Message frequency may vary.

Message and data rates may apply.

Users may opt out at any time by replying STOP.

Users may obtain assistance by replying HELP or contacting CareSnap support.

CareSnap does not sell, rent, share, transfer, or disclose mobile phone numbers, SMS consent records, or SMS messaging information to third parties or affiliates for marketing or promotional purposes.

SMS consent is not shared with third parties or affiliates for marketing purposes.

Privacy

Use of the Services is also governed by the CareSnap Privacy Policy.

By using the Services, you acknowledge that information may be collected, processed, stored, and disclosed as described in the Privacy Policy.

User Content

Users may submit information, messages, schedules, assignments, notes, documents, and other content through the Services.

Users retain ownership of their content.

By submitting content, users grant CareSnap a limited right to host, process, transmit, display, and store such content solely for the purpose of operating and providing the Services.

Users are responsible for ensuring that submitted content is lawful and that they possess all necessary permissions to provide such content.

Intellectual Property

The Services, including software, text, graphics, logos, trademarks, designs, content, and technology, are owned by CareSnap or its licensors and are protected by applicable intellectual property laws.

Nothing in these Terms transfers ownership rights to users.

Users may not reproduce, distribute, modify, reverse engineer, or create derivative works from the Services without prior written permission.

Service Availability

CareSnap strives to maintain reliable Services but does not guarantee uninterrupted or error-free operation.

Services may occasionally be unavailable due to:

  • Maintenance

  • Updates

  • Technical issues

  • Third-party service interruptions

  • Circumstances beyond CareSnap's control

CareSnap may modify, suspend, or discontinue portions of the Services at any time.

Third-Party Services

The Services may interact with third-party platforms, telecommunications providers, mapping services, cloud infrastructure providers, or other service providers.

CareSnap is not responsible for the availability, accuracy, or practices of third-party services.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARESNAP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND AVAILABILITY.

CARESNAP DOES NOT GUARANTEE THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, OR COMPLETELY SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARESNAP SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE USE OF THE SERVICES.

CARESNAP'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF:

(A) ONE HUNDRED U.S. DOLLARS ($100); OR

(B) THE AMOUNT PAID TO CARESNAP FOR SERVICES DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Indemnification

Users agree to defend, indemnify, and hold harmless CareSnap, Inc., its officers, directors, employees, affiliates, contractors, and agents from claims, damages, liabilities, losses, and expenses arising from:

  • Violation of these Terms;

  • Misuse of the Services;

  • Violation of applicable laws;

  • Infringement of third-party rights.

Termination

CareSnap may suspend or terminate access to the Services at any time if:

  • These Terms are violated;

  • Required by law;

  • Necessary to protect users, systems, or business operations.

Users may discontinue use of the Services at any time.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.

Changes to These Terms

CareSnap may update these Terms periodically.

Updated Terms will be posted on this page with a revised Effective Date.

Continued use of the Services after updates become effective constitutes acceptance of the revised Terms.
